Die Klägerin arbeitete als kaufmännische Mitarbeiterin beim Beklagten. Im Verfahren vor Arbeitsgericht nahm für den Beklagten (eine juristische Person) der für das Lohnwesen zuständige Quästor teil. Dieser ist selber Fachrichter am Arbeitsgericht des Kantons Luzern. Die Klägerin machte diesbezüglich mit Nichtigkeitsbeschwerde die Verletzung wesentlicher Verfahrensvorschriften geltend.
Aus den obergerichtlichen Erwägungen:
Die Klägerin sieht eine Verletzung wesentlicher Verfahrensvorschriften darin, dass sich der Beklagte an der Verhandlung durch Z. vertreten liess. Dass beim Beklagten ausgerechnet ein Fachrichter des Arbeitsgerichts für das Lohnwesen zuständig ist, bedeutet nicht, dass dieser nicht als Partei vor Arbeitsgericht erscheinen konnte. Diesbezüglich liegt offensichtlich kein Verfahrensmangel vor. Dass diese Konstellation eintreten kann, liegt im System des Fachrichtertums am Arbeitsgericht und kann für sich allein genommen zweifellos keinen Ausstandsgrund für das Gericht bilden. Dass das Fachgericht, in dem auch die Arbeitnehmerseite vertreten ist, wegen Z. tatsächlich befangen gewesen wäre, wird selbst von der Klägerin nicht konkret behauptet. Anhaltspunkte für die Annahme von Befangenheit dieses paritätisch zusammengesetzten Gerichts sind denn auch aus den Akten nicht ersichtlich.
(Die gegen diesen Entscheid erhobene staatsrechtliche Beschwerde wurde vom Bundesgericht am 20. August 1997 abgewiesen.)
