The court held that an indefinite prohibition on keeping animals imposed on a person who had mistreated his dog was disproportionate. The measure was therefore reduced to a ban of six years. The dog had been seized as a provisional measure, but the dispositive issue was the duration of the keeping prohibition.

A prohibition on keeping animals must be suitable, necessary, and proportionate in the strict sense in light of the seriousness of the animal welfare violation and the risk of recurrence. An unlimited ban is exceptional and requires particularly weighty reasons. Where such reasons are absent, the court may substitute a fixed-term prohibition corresponding to the circumstances of the case.
