The case concerns the calculation of social-housing rent and surcharge under the Geneva Housing Act. The key question was whether the tenant's son, who had stayed abroad for ten months for school and tourism, still formed part of the common household. The court held, in line with prior case law, that a temporary absence does not sever membership in the family unit when the child intends to return to the mother's home at the end of the stay.

The child continues to belong to the common household if the stay abroad is temporary and there is an intention to return to the mother’s home.
