The case concerns accident-insurance coverage after a whiplash-type cervical trauma. The court accepted natural and adequate causation between the accident and the insured person's physical pain. On that basis, it upheld the award of an impairment-of-integrity indemnity for the pain suffered.
Art. 6 al. 1 LAA; whiplash-type cervical trauma and impairment of integrity: where the accident causes persistent physical pain, natural and adequate causation may be admitted and an indemnity for impairment of integrity awarded for the bodily suffering. The decisive factor is the accident-related somatic symptomatology; the compensable impairment need not be limited to objectively measurable structural lesions, provided the pain is sufficiently attributable to the insured event.
