The court held that CNA could generally stop its former practice of reimbursing all non-medical hospital costs of an insured who had become entitled to an AI pension. However, in the concrete case, the principle of good faith prevented CNA from applying the change against the insured because CNA already had a French judgment against the tortfeasor's liability insurer for reimbursement of part of those costs. Had CNA not paid them under its old practice, the insured could have claimed them directly in the French proceedings; he could not be required to restart litigation abroad.

Il serait contraire à la bonne foi d’imposer à l’assuré l’ouverture d’une nouvelle procédure à l’étranger (consid. non précisé).

La CNA a la faculté de mettre fin unilatéralement à sa pratique consistant au remboursement à bien plaire de l'intégralité des frais d'hospitalisation non-médicaux d'un assuré impotent nécessitant des soins constants, au motif qu'il est depuis peu au bénéfice d'une rente AI. Dans le cas particulier cependant, en application du principe de la confiance, tel ne pouvait être le cas, car la CNA était au bénéfice d'un jugement français condamnant l'assureur RC du responsable de l'accident à lui rembourser une partie des frais produits, dont les prestations à bien plaire. Or, si la CNA ne les avait pas remboursés selon son ancienne pratique, l'assuré aurait pu les faire valoir directement contre l'assureur RC dans le cadre du procès français. Il ne se justifie pas d'imposer à l'assuré de recommencer une procédure en France.
