Un hébergement conçu comme temporaire dès le départ peut justifier une surtaxe si sa durée est relativement longue. En l'espèce, bien que la recourante ait hébergé un ami de son fils pendant 6 mois, une surtaxe ne se justifiait pas en considération des particularités du cas. La recourante avait en effet dès le début informé l'OLS de l'arrivée de la personne hébergée et lui avait communiqué son revenu. L'OLS était donc en mesure de s'apercevoir que l'addition des revenus allait entraîner une surtaxe prohibitoire. Il aurait dû notifier rapidement l'avis de surtaxe. Si la recourante avait réalisé l'augmentation conséqunte de la surtaxe, elle aurait renoncé à l'hébergement.
