J. and A. filed a complaint with the Federal Administrative Court concerning the processing of a visa application for G. The court held that no appealable administrative decision existed and that there was no denial or delay of justice by the Federal Office for Migration. Because the matter was not yet within the court’s review competence, the filing had to be transmitted to the BFM for examination. The appeal was therefore not entered into, and no court costs were imposed.

Art. 31, 32 VGG; Art. 5, 8 Abs. 1, 46a VwVG: The Federal Administrative Court may hear complaints only against appealable decisions of the authorities listed in Art. 33 VGG. Where the file discloses neither an appealable decision nor a denial or delay of justice, the court lacks appellate competence and must not enter into the matter. In such a situation, the submission is to be forwarded ex officio to the competent first-instance authority under Art. 8 Abs. 1 VwVG. If the appeal is not entered into, no procedural costs are generally charged to the appellants (Art. 63 Abs. 1 VwVG; Art. 6 lit. b VGKE).
