In an AI appeal against a Federal Administrative Court decision of inadmissibility, the Federal Supreme Court held that the appellant's filing did not address the formal defects identified below and did not contain topically relevant reasoning. Because the appeal failed to comply with Art. 42 LTF, the President refused entry under the simplified procedure of Art. 108(1)(b) LTF. In view of the circumstances, no judicial costs were charged.

Art. 42 cpv. 1-2 LTF; Art. 108 cpv. 1 lett. b LTF; inadmissibility of an appeal for insufficient reasoning. A federal appeal must set out conclusions and reasoning directed to the subject matter of the dispute; the reasoning must specifically engage with the grounds of the challenged judgment. Where the lower court declares an appeal inadmissible, a merits-based critique does not satisfy the requirement of topical reasoning. If the appellant fails to address the formal reasons for inadmissibility, the Federal Supreme Court does not enter into the matter in simplified procedure (consid. 1). Under Art. 66 cpv. 1 in fine LTF, judicial costs may be waived in light of the circumstances (consid. 2).

II Corte di diritto sociale

Composizione
Giudice federale U. Meyer, Presidente,

Oggetto

66 cpv. 1 in fine LTF),

per questi motivi, il Presidente pronuncia:

1.
Il ricorso è inammissibile.

2.
Non si prelevano spese giudiziarie.

3.
Comunicazione alle parti, al Tribunale amministrativo federale,
Corte III, e all'Ufficio federale delle assicurazioni sociali.
