The Federal Supreme Court did not enter into the appeal against a Federal Administrative Court judgment because the filing failed to meet the federal reasoning requirements. The appellant's arguments about his deteriorating health did not show why the non-entry decision violated federal law. Because the appeal was inadmissible from the outset, the request for free legal aid was refused. The court waived the imposition of court costs.

Art. 42 Abs. 1 and 2 BGG; Art. 108 Abs. 1 lit. b BGG: An appeal is inadmissible if it lacks requests or a sufficiently concrete, case-related statement of reasons showing in what respect the challenged decision infringes federal law. The appellant must engage with the reasoning of the contested judgment; purely factual submissions or general assertions do not suffice. Where the appeal is manifestly non-compliant with the reasoning requirement, the court may refuse to enter into the matter in summary procedure. A request for legal aid under Art. 64 Abs. 1 BGG fails where the appeal is inadmissible ab initio. In exceptional circumstances, costs may be waived under Art. 66 Abs. 1 in fine BGG.

Beschwerde gegen den Entscheid des Bundesverwaltungsgerichts vom 5. Juli 2007.

Der Präsident der II. sozialrechtlichen Abteilung hat nach Einsicht
in die Beschwerde vom 9. August 2007 gegen einen Entscheid des Bundesverwaltungsgerichts vom 5. Juli 2007, lautend auf Nichteintreten zufolge Verspätung,
in Erwägung,
BGE 131 II 449 E. 1.3 S. 452),

Questione giuridica chiave

Whether the federal appeal met the statutory reasoning requirements for admissibility.

Decisione estratta

No. The filing did not explain, in a focused and case-specific way, how the appealed judgment violated federal law.

Motivazione estratta

Under Art. 42 BGG, an appeal must state requests and reasons and show concretely how the decision infringes the law. The appellant's submissions about his worsened health did not address the non-entry decision itself, so the appeal was manifestly insufficiently reasoned and inadmissible under Art. 108 Abs. 1 lit. b BGG.

Questione giuridica chiave

Whether free legal aid could be granted despite the appeal's inadmissibility.

Decisione estratta

No. Since the appeal was inadmissible from the outset, free legal aid could not be granted.

Motivazione estratta

Art. 64 Abs. 1 BGG presupposes a non-frivolous and procedurally viable request; that condition was not met here.

Questione giuridica chiave

Whether court costs should be charged to the appellant.

Decisione estratta

No court costs were imposed in view of the circumstances.

Motivazione estratta

The court exercised its discretion under Art. 66 Abs. 1 in fine BGG and waived costs.
