Sintesi Omnilex

The appellants challenged a cantonal non-entry decision in a health insurance matter, but their federal appeal contained no requests and no sufficient reasoning. After being notified of the formal defects and the possibility of correction within the appeal period, they did not respond. The Federal Supreme Court held the filing to be manifestly inadmissible and, in simplified procedure, declined to enter into the appeal. It waived court costs.

Massima Omnilex

Art. 42 Abs. 1 and 2 BGG; art. 108 Abs. 1 lit. b BGG: admissibility requirements of the appeal and non-entry for manifestly insufficient submissions. An appeal must contain specific requests and, in concise form, reasons showing how the challenged decision violates federal law. Where a complaint against a non-entry decision addresses only the merits of the underlying dispute and does not explain why the lower court should have entered into the case, it lacks a legally sufficient subject-matter reasoning. If the defect is not cured within the appeal period after judicial warning, the remedy is manifestly inadmissible and may be dismissed in simplified procedure (consid. 1). Costs may exceptionally be waived under art. 66 Abs. 1 sentence 2 BGG.

Urteil vom 30. September 2011
II. sozialrechtliche Abteilung

Besetzung
Bundesrichter U. Meyer, Präsident,
Gerichtsschreiber Ettlin.

Verfahrensbeteiligte

  1. O.________,
  2. L.________,

Beschwerdeführer,

gegen

CONCORDIA Schweizerische Kranken- und Unfallversicherung AG, Bundesplatz 15, 6003 Luzern,
Beschwerdegegnerin.

Gegenstand
Krankenversicherung (Prozessvoraussetzung),

in Erwägung,

Questione giuridica chiave

Whether the appeal complied with the formal requirements of Art. 42 BGG regarding requests and reasoning.

Decisione estratta

The filing did not contain any request or adequate reasoning and was therefore not a valid appeal.

Motivazione estratta

An appeal must state requests and reasons showing how the challenged decision violates the law. In a non-entry case, merely addressing the merits is insufficient. The appellants did not explain why the lower court should have entered into the matter.

Questione giuridica chiave

Whether the Federal Supreme Court could enter into the appeal under the simplified procedure.

Decisione estratta

The court could not enter into the appeal because it was manifestly inadmissible.

Motivazione estratta

Since the appeal was obviously defective and the warning letter remained unanswered, no valid remedy had been filed. Non-entry was therefore appropriate under the simplified procedure.

Questione giuridica chiave

Whether court costs should be charged.

Decisione estratta

No court costs were imposed in view of the circumstances.

Motivazione estratta

The court waived costs under the exceptional cost rule, considering the case circumstances.
