Z.________ appealed to the Federal Supreme Court against a non-entry decision of the Federal Administrative Court in a BVG dispute. The Court held that the appeal did not satisfy the reasoning requirements of Art. 42 BGG because it did not explain why the lower court should have entered into the case. In the simplified procedure, the appeal was therefore not entered into. Owing to the circumstances, no court costs were levied.

Art. 42 Abs. 1 und 2 BGG; Art. 108 Abs. 1 lit. b BGG: An appeal against a non-entry decision is inadmissible if it merely addresses the merits of the underlying dispute and fails to show, in a concise and case-specific manner, why the lower court should have entered into the matter. The reasoning requirement is not satisfied by submissions that do not engage with the alleged procedural defect of the challenged decision. In such a case, the Federal Supreme Court may dispose of the matter in simplified procedure. Art. 66 Abs. 1 Satz 2 BGG permits waiver of court costs in view of the circumstances (consid. 1).

II. sozialrechtliche Abteilung

Besetzung
Bundesrichter U. Meyer, Präsident,
Gerichtsschreiberin Bollinger Hammerle.

Parteien
Z.________, Beschwerdeführer,

gegen

Stiftung Auffangeinrichtung BVG, Erlenring 2, 6343 Rotkreuz,
Beschwerdegegnerin.

Gegenstand
Berufliche Vorsorge,

Beschwerde gegen den Entscheid des Bundesverwaltungsgerichts vom 8. Mai 2009.

Mai 2009,
in Erwägung,

No. The appeal did not address in a sufficient, case-specific manner why the Federal Administrative Court should have entered on the complaint.

Questione giuridica chiave

Whether court costs should be charged for the inadmissible appeal.

Decisione estratta

No court costs were imposed due to the circumstances.

Motivazione estratta

The Court exercised its discretion under Art. 66(1) second sentence BGG and waived costs.
