The Federal Supreme Court, sitting as a single judge in a disability insurance case, found that the appellant’s submission of 22 April 2013 did not meet the minimum reasoning requirements of Art. 42 BGG. The appeal amounted only to appellatory criticism and did not show that the factual findings were manifestly incorrect or legally flawed under Arts. 97 and 105 BGG. The court therefore did not enter into the appeal in simplified procedure under Art. 108 BGG and waived court costs under Art. 66 BGG.

Art. 42 Abs. 1 und 2 BGG; Art. 97 Abs. 1, Art. 105 Abs. 1 und 2 BGG; Art. 108 Abs. 1 lit. b und Abs. 2 BGG; non-entry for insufficient reasoning: an appeal must state in a concise manner how the contested decision violates law. Mere appellatory criticism does not satisfy the reasoning requirement, in particular where factual findings are attacked without showing manifest error. A filing that fails these minimum requirements is not a valid legal remedy and may be disposed of in simplified procedure without entering into the merits. When non-entry is ordered, costs may be waived under Art. 66 Abs. 1 second sentence BGG.

Urteil vom 7. Juni 2013

II. sozialrechtliche Abteilung

Besetzung
Bundesrichter Meyer, als Einzelrichter,
Gerichtsschreiber Schmutz.

Verfahrensbeteiligte
T.________,
vertreten durch Beratungsstelle für Ausländer, M. Milovanovic,
Beschwerdeführer,

gegen

IV-Stelle des Kantons Zürich, Röntgenstrasse 17, 8005 Zürich,
Beschwerdegegnerin.

Gegenstand
Invalidenversicherung,

in Erwägung,

Questione giuridica chiave

Whether the appeal met the minimum reasoning requirements under the Federal Supreme Court Act.

Decisione estratta

The appeal did not satisfy the statutory reasoning requirements because it did not show, in a sufficiently concise manner, how the challenged decision violated the law and relied only on appellatory criticism.

Motivazione estratta

Under Art. 42(1) and (2) BGG, an appeal must include requests and reasons. The submissions did not demonstrate that the factual findings were manifestly incorrect or that the ensuing reasoning was legally erroneous within the meaning of Art. 97(1) and Art. 105(1) and (2) BGG.

Questione giuridica chiave

Whether the Federal Supreme Court could enter into the appeal in simplified procedure.

Decisione estratta

The court held that the deficiently reasoned filing was not a valid legal remedy and therefore no merits review was possible; the appeal was not entered into in simplified procedure.

Motivazione estratta

Because the appeal was clearly insufficiently reasoned, non-entry was warranted under Art. 108(1)(b) and (2) BGG.

Questione giuridica chiave

Whether court costs should be charged.

Decisione estratta

No court costs were charged.

Motivazione estratta

The court waived costs pursuant to Art. 66(1) second sentence BGG.
