Sintesi Omnilex

The appellant challenged a cantonal social insurance non-entry decision before the Federal Supreme Court. The Court held that the appeal did not comply with Art. 42 BGG because it failed to address the cantonal court's reasoning concerning the requirements for the lower-court appeal and the missed deadline to cure defects. In simplified proceedings under Art. 108(1)(b) BGG, the Court therefore did not enter into the appeal. Court costs were waived under Art. 66(1) sentence 2 BGG.

Art. 42 Abs. 1 und 2 BGG; Art. 108 Abs. 1 lit. b BGG; Art. 66 Abs. 1 Satz 2 BGG: An appeal against a non-entry decision must specifically engage with the reasoning of the challenged decision; a submission confined to the merits of the underlying dispute is not a legally sufficient appeal. Where the deficiency is apparent from the filing, the Federal Supreme Court may decline to enter in simplified proceedings. If the appeal is not entered into, court costs may be waived.

Gegenstand
Krankenversicherung,

Januar 2010.

Nach Einsicht
in die Beschwerde vom 11. März 2010 (Poststempel) gegen den Entscheid 730 09 379/19 des Kantonsgerichts Basel-Landschaft vom 21. Januar 2010,
in Erwägung,

Questione giuridica chiave

Whether the appeal met the reasoning requirements under Art. 42 BGG

Decisione estratta

No. The brief did not engage with the cantonal court's reasons for non-entry and therefore lacked a sufficient, issue-specific legal argument.

Motivazione estratta

Under Art. 42(1)-(2) BGG, an appeal must state requests and reasons and show, in concise form, how the challenged decision violates law. An appeal against a non-entry decision that argues only the merits does not satisfy this standard.

Questione giuridica chiave

Whether simplified non-entry proceedings were appropriate

Decisione estratta

Yes. Because the appeal was manifestly insufficiently reasoned, the Court could decide in simplified proceedings and not enter into the merits.

Motivazione estratta

The deficiency was apparent from the filing itself, so non-entry under Art. 108(1)(b) BGG was warranted.

Questione giuridica chiave

Whether court costs should be charged

Decisione estratta

No court costs were levied.

Motivazione estratta

The Court applied the second sentence of Art. 66(1) BGG and waived costs.
