C.________ challenged the denial of unemployment benefits by the Cantonal Unemployment Fund of St. Gallen. The Federal Court upheld the cantonal judgment, holding that as a board member of the company he had a statutory position of significant influence and was therefore excluded from unemployment compensation under AVIG. The Court rejected the argument that his small shareholding and lack of management powers required further factual inquiry. It found the appeal manifestly unfounded, decided it in simplified procedure, and charged the appellant with court costs of CHF 500.

Art. 31 Abs. 3 lit. c AVIG; entitlement to unemployment compensation of a member of the board of directors: the personal exclusion ground applies to a board member as such when the statutory capacity for influence exists; neither the extent of shareholding nor the concrete internal allocation of management powers is decisive, and no further inquiry into the company's organization or the individual's specific responsibilities is required (consid. 2). An appeal that raises no cognizable error against this assessment is manifestly unfounded and may be disposed of in simplified procedure under Art. 109 Abs. 2 lit. a and Abs. 3 BGG; costs follow the loss under Art. 66 Abs. 1 BGG.

gegen

Kantonale Arbeitslosenkasse St. Gallen, Davidstrasse 21, 9000 St. Gallen,
Beschwerdegegnerin.

Gegenstand
Arbeitslosenversicherung (Arbeitslosenentschädigung),

Beschwerde gegen den Entscheid des Versicherungsgerichts des Kantons St. Gallen
vom 25. August 2009.

In Erwägung,
