Sintesi Omnilex

The Federal Supreme Court dealt with two filings by an insured person in an IV matter concerning cantonal revision proceedings. It held that the submissions did not reveal any genuine intent to appeal the cantonal order; the appellant merely wanted the cantonal court to reopen revision proceedings. Because the filing therefore lacked the required appeal intent, the complaints were not entered into. The court also noted that the appellant could still file a revision request with the cantonal court after finality of the dismissal order, based on the newly invoked medical report. Free legal aid was refused, and no court costs were charged.

Massima Omnilex

Art. 42 BGG; admissibility requires a recognizable request for appellate review and appeal intent. Where a party’s submission is directed solely to obtaining reopening or revision before the cantonal authority and does not seek treatment of the filing as a federal appeal, the Federal Supreme Court does not enter into the matter for lack of appeal will. The availability of a still timely revision request before the competent cantonal authority may also militate against legal aid in the federal proceedings (Art. 64 BGG). Costs may be waived under Art. 66 Abs. 1 Satz 1 BGG when the circumstances so justify.

dass zur Beurteilung der Eingabe der Einzelrichter zuständig ist (Art. 108 BGG),

Questione giuridica chiave

Whether the filings showed an intent to appeal the cantonal transfer/order to the Federal Supreme Court.

Decisione estratta

No appeal intent could be discerned; the complaints were therefore not admissible for lack of a recognizable challenge.

Motivazione estratta

The appellant aimed solely at having the cantonal court open revision proceedings again. He did not seek admission of the filing of 26 August 2009 as a public-law appeal, so the required intent to appeal under Art. 42 BGG was missing.

Questione giuridica chiave

Whether the appellant had to be allowed to refile a revision request before the cantonal court after the revision ground was discovered.

Decisione estratta

Yes. A revision request could still be filed with the court that issued the challenged decision within the statutory period after discovery of the revision ground.

Motivazione estratta

Under Art. 61 lit. i ATSG in connection with Art. 106 VRG/FR, the appellant could again file a timely revision request based on the newly asserted medical report even after the dismissal order became final.

Questione giuridica chiave

Whether free legal aid should be granted for this federal proceedings.

Decisione estratta

Denied, because the matter did not justify legal aid in view of the inadmissibility and the available cantonal remedy path.

Motivazione estratta

Since the appellant could still submit a revision request to the cantonal court, assistance for the present proceedings was not warranted under Art. 64 BGG.

Questione giuridica chiave

Whether court costs should be charged.

Decisione estratta

No court costs were levied.

Motivazione estratta

The court waived costs under Art. 66 Abs. 1 Satz 1 BGG.
