Sintesi Omnilex

A claimant appealed a Federal Administrative Court decision concerning invalidity insurance. The Federal Supreme Court held that the appeal was not sufficiently reasoned because it merely repeated arguments already made below and did not engage with the lower court's reasoning. In simplified procedure, the court therefore declined to enter into the appeal. It also waived court costs under the Federal Supreme Court Act.

Massima Omnilex

Art. 42 Abs. 1-2 BGG; reasoning requirements of the appeal: a party must, in a concise and case-specific manner, address the contested decision and indicate which legal provisions were violated and why. Mere repetition of submissions made below does not satisfy the duty to reason. If the appeal manifestly fails to meet these requirements, non-entry is ordered in simplified procedure under Art. 108 Abs. 1 lit. b BGG. Court costs may be waived under Art. 66 Abs. 1 second sentence BGG.

Gegenstand
Invalidenversicherung (Prozessvoraussetzung),

Beschwerde gegen den Entscheid des Bundesverwaltungsgericht
vom 26. Juni 2009.

Juni 2009,

in Erwägung,
Ziff.

Questione giuridica chiave

Whether the appeal met the reasoning requirements under Art. 42 BGG.

Decisione estratta

No. The appeal did not engage with the challenged decision's reasoning and therefore lacked the required substantiated explanation of legal error.

Motivazione estratta

The submissions repeated what had already been argued below without addressing the specific considerations of the Federal Administrative Court; under Art. 42(1)-(2) BGG, the appeal must briefly and concretely show how the decision violates law.

Questione giuridica chiave

Whether the appeal could be entered into in simplified procedure under Art. 108(1)(b) BGG.

Decisione estratta

No entry was possible because the appeal was manifestly insufficiently reasoned.

Motivazione estratta

Since the appellant failed to comply with the formal reasoning requirements, the president could not examine the merits and issued a non-entry decision in simplified procedure.

Questione giuridica chiave

Whether court costs should be charged.

Decisione estratta

No court costs were imposed.

Motivazione estratta

Applying Art. 66(1) second sentence BGG, the court waived the collection of judicial costs.
