Sintesi Omnilex

The appellant challenged a cantonal disability-insurance judgment, but the Federal Court held that the appeal did not comply with the statutory duty to give reasons. The submission failed to address the decisive factual findings and evidentiary assessment of the cantonal court, which had explained why it relied on the SMAB expertise of 1 April 2011. As the deficiency was obvious, the court did not enter into the appeal in simplified procedure. No court costs were charged.

Art. 42 Abs. 1 und 2 BGG; Art. 108 Abs. 1 lit. b BGG: An appeal must specifically engage with the reasoning of the challenged judgment and show, in concise form, how it violates the law; mere appellatory criticism or reference to medical reports already discussed by the lower court is insufficient. The Federal Court bases its review on the facts established by the cantonal court (Art. 105 Abs. 1 BGG) and departs therefrom only under the conditions of Art. 105 Abs. 2 BGG. Where the substantiation defect is manifest, non-entry may be ordered in simplified procedure. Cost waiver may be granted under Art. 66 Abs. 1 second sentence BGG.

Urteil vom 26. Juni 2012

Besetzung
Bundesrichter Ursprung, Präsident,
Gerichtsschreiber Grünvogel.

Verfahrensbeteiligte
Z.________,
Beschwerdeführer,

gegen

IV-Stelle des Kantons Zürich,
Röntgenstrasse 17, 8005 Zürich,
Beschwerdegegnerin.

Gegenstand
Invalidenversicherung (Prozessvoraussetzung),

in Erwägung,

Questione giuridica chiave

Whether the appeal met the reasoning requirements of Art. 42 BGG

Decisione estratta

No. The appellant did not engage with the decisive reasons of the cantonal judgment and relied only on appellatory criticism and medical reports already addressed below.

Motivazione estratta

An appeal must explain in a concise manner how the challenged decision violates the law. Mere repetition of medical reports is insufficient, especially where the lower court thoroughly explained why it relied on the SMAB expertise and not on other doctors.

Questione giuridica chiave

Whether the Federal Court should enter into the appeal under the simplified procedure of Art. 108(1)(b) BGG

Decisione estratta

No. The defect was obvious, so the appeal had to be dismissed without entering into the merits.

Motivazione estratta

Because the appeal manifestly failed to satisfy the statutory substantiation requirement, summary non-entry was appropriate.

Questione giuridica chiave

Court costs

Decisione estratta

No court costs were charged.

Motivazione estratta

The court exercised its discretion to waive costs under Art. 66(1) second sentence BGG.
