The claimant appealed to the Federal Supreme Court against a cantonal decision upholding the denial of an invalidity pension. He did not challenge the pension assessment itself but asked the court to order the IV office to reconsider vocational measures. The court held that this request lay outside the disputed object of the cantonal and administrative decisions, and therefore refused to enter into the appeal in the simplified procedure. Because the appeal was hopeless, legal aid with counsel was denied. The court also waived court costs.
Art. 108 Abs. 1 lit. b BGG; the Federal Supreme Court will not enter into an appeal if the appellant raises only requests that fall outside the scope of the contested decision and the dispute determined thereby. The litigated object is defined by the administrative decision and, where applicable, the cantonal judgment; new or different claims not encompassed by that object are inadmissible in federal proceedings. Where the appeal is manifestly inadmissible, it is deemed devoid of prospects of success for purposes of Art. 64 BGG, so legal aid is refused. In simplified procedure, the court may dispense with court costs under Art. 66 Abs. 1 second sentence BGG.

in die Beschwerde vom 24. Dezember 2008 (Poststempel) gegen den Entscheid des Sozialversicherungsgerichts des Kantons Zürich vom 29. Oktober 2008 und das Gesuch um unentgeltliche Rechtspflege mit Verbeiständung,
in Erwägung,
dass die Vorinstanz im angefochtenen Entscheid die Verfügung der IV-Stelle des Kantons Zürich vom 14. März 2007 bestätigt hat, worin ein Anspruch des Beschwerdeführers auf eine Invalidenrente wegen eines zu geringen Invaliditätsgrads (gemäss IV-Stelle von 12 %; gemäss dem kantonalen Gericht von gerundeten 11%) verneint worden ist,
dass der Beschwerdeführer dagegen lediglich vorbringt, nachdem nun der fehlende Anspruch auf eine Invalidenrente feststehe, müssten von der Invalidenversicherung von Amtes wegen erneut berufliche Massnahmen ins Auge gefasst werden, was vom Gericht anzuordnen sei,
dass diese Frage indessen ausserhalb des durch die angefochtene Verfügung bzw. den angefochtenen Entscheid vorgegebenen Steitgegenstands liegt,
dass deshalb im vereinfachten Verfahren nach Art. 108 Abs. 1 lit. b BGG auf die Beschwerde nicht einzutreten ist und in Anwendung von Art. 66 Abs. 1 Satz 2 BGG auf die Erhebung von Gerichtskosten verzichtet wird,
dass das Gesuch um unentgeltliche Rechtspflege - soweit nicht durch die Gerichtskostenbefreiung gegenstandslos geworden - wegen aussichtsloser Beschwerdeführung abgewiesen wird (Art. 64 BGG),
erkennt der Präsident:

Auf die Beschwerde wird nicht eingetreten.
2.
Das Gesuch um unentgeltliche Rechtspflege wird abgewiesen.
3.
Es werden keine Gerichtskosten erhoben.
4.
Dieses Urteil wird den Parteien, dem Sozialversicherungsgericht des Kantons Zürich und dem Bundesamt für Sozialversicherungen schriftlich mitgeteilt.
