The Federal Supreme Court dealt with a criminal complaint against a cantonal ruling that had refused to enter into an appeal as out of time. The appellant argued that he could not accept the written dispositive at the first-instance hearing for psychological reasons. The Court held that the cantonal court correctly treated refusal of personal handover as service and that the complaint did not establish a violation of federal law. The complaint was therefore not entered into. The request for free legal aid was denied as hopeless, and reduced court costs of CHF 500 were imposed on the appellant.

Art. 384 lit. a and Art. 85 Abs. 4 lit. b StPO; Art. 95, 64, 65 and 66 BGG; timeliness of appeal and legal effect of refusal to accept personal service. When the written dispositive is personally handed over, the appeal period begins with that handover; refusal of acceptance by the addressee counts as service on the same day. A federal complaint that merely asserts subjective reasons for non-acceptance, without showing an infringement of federal law in the calculation of the deadline, is inadmissible under Art. 108 BGG. Free legal aid is refused where the filing has no prospects of success; costs may be reduced according to the party's financial situation (consid. 1-2).

Urteil vom 29. Februar 2012
Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Einzelrichter,
Gerichtsschreiberin Arquint Hill.

Verfahrensbeteiligte
X.________,
Beschwerdeführer,

gegen

Oberstaatsanwaltschaft des Kantons Zürich, Florhofgasse 2, 8001 Zürich,
Beschwerdegegnerin.

Gegenstand
Verspätete Berufung (einfache Körperverletzung etc.),

Beschwerde gegen den Beschluss des Obergerichts
des Kantons Zürich, II. Strafkammer, vom 11. November 2011.

Der Einzelrichter zieht in Erwägung:

1.

4.
Dieses Urteil wird den Parteien und dem Obergericht des Kantons Zürich, II. Strafkammer, schriftlich mitgeteilt.

Questione giuridica chiave

Whether the federal complaint against the cantonal non-entry ruling was admissible despite the alleged defect in service and the missed deadline.

Decisione estratta

The complaint did not show that the cantonal court violated federal law in holding the appeal deadline to run from service of the written dispositive; the complaint was therefore inadmissible.

Motivazione estratta

The lower court relied on Art. 384 lit. a and Art. 85(4)(b) CPC, under which the appeal period begins upon service or handover of the written dispositive. Refusal to accept personal delivery counts as service on that day. The appellant's assertion that psychological reasons prevented acceptance did not demonstrate an unlawful application of federal law under Art. 95 BGG.

Questione giuridica chiave

Whether the appellant was entitled to free legal aid and representation before the Federal Supreme Court.

Decisione estratta

The request was denied because the complaint had no prospects of success.

Motivazione estratta

Legal aid under Art. 64 BGG is unavailable for an obviously hopeless filing.

Questione giuridica chiave

How court costs should be allocated.

Decisione estratta

Court costs were imposed on the appellant, reduced in light of his financial situation.

Motivazione estratta

As the complaint was inadmissible, costs followed the outcome; the fee was reduced under Art. 65(2) BGG.
