Sintesi Omnilex

The Federal Supreme Court did not enter into the appellant’s complaint in a criminal matter because she failed to engage with the cantonal court’s reasoning and did not substantiate any violation of federal law. To the extent she relied on new facts, these were inadmissible novelties. The request for suspensive effect became moot. Court costs of CHF 800 were charged to the appellant.

Art. 42 Abs. 2, Art. 99 Abs. 1, Art. 106 Abs. 2, Art. 108 BGG; requirements for admissibility of a federal complaint in criminal matters. A complaint must, in a reasoned manner, deal with the decisive considerations of the challenged decision and indicate which federal rights were violated. Mere assertion or repetition of the case theory is insufficient. New factual allegations are inadmissible unless the statutory exceptions are met. Where these requirements are not satisfied, the court does not enter into the complaint by simplified procedure (consid. 1).

Gegenstand
Ehrverletzung; Kosten; Willkür,

Beschwerde gegen den Beschluss des Obergerichts des Kantons Zürich, I. Strafkammer, vom 29. August 2011.
Der Einzelrichter zieht in Erwägung:

1.

Questione giuridica chiave

Whether the federal criminal complaint met the reasoning requirements and could be examined on the merits.

Decisione estratta

No. The complaint did not address the cantonal reasoning and failed to show any violation of federal law or arbitrary application of cantonal criminal procedure; it was therefore inadmissible.

Motivazione estratta

The appellant merely repeated allegations and relied on new facts. This did not satisfy Art. 42(2) and Art. 106(2) BGG, and the new material was inadmissible under Art. 99(1) BGG. The court therefore could not enter into the merits under Art. 108 BGG.

Questione giuridica chiave

Whether the request for suspensive effect remained pending.

Decisione estratta

No. It became moot once the court decided not to enter into the complaint.

Motivazione estratta

The final procedural decision on the complaint rendered the request without object.

Questione giuridica chiave

Allocation of federal court costs.

Decisione estratta

The costs were imposed on the appellant.

Motivazione estratta

As the complaint was not entered into, the appellant had to bear the court costs under Art. 66(1) BGG.
