The appellant sought federal review of a cantonal decision concerning the opening of an investigation against public officials. The Federal Supreme Court ordered him to pay an advance on costs, granted a grace period after non-payment, and warned that the appeal would otherwise not be entered upon. He again refused to pay. The court held that no special grounds justified a waiver of the advance and that the statutory consequence under the BGG had to follow. The appeal was therefore not entered into, and the appellant was charged with court costs of CHF 1,000.

Art. 62 Abs. 1, Art. 108 BGG; advance on costs as a prerequisite for admissibility and non-entry for non-payment. In principle, each party must pay an advance on costs corresponding to the expected court costs; waiver is possible only for special reasons. If the advance is neither paid within the original time limit nor within the grace period, the Federal Supreme Court does not enter upon the remedy under the summary procedure of Art. 108 BGG. The unsuccessful party bears the court costs under Art. 66 Abs. 1 BGG; in fixing the fee, the court may take account of vexatious or dilatory conduct under Art. 65 Abs. 2 BGG.

Urteil vom 13. Oktober 2009
Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider Einzelrichter,
Gerichtsschreiber Monn.

Parteien
X.________,
Beschwerdeführer,

gegen

Oberstaatsanwaltschaft des Kantons Zürich, 8090 Zürich,
Beschwerdegegnerin.

Gegenstand
Eröffnung einer Untersuchung gegen Behördenmitglieder und Beamte,

Beschwerde gegen den Beschluss des Obergerichts des Kantons Zürich, II. Zivilkammer, vom 6. Juli 2009 (NS090012/U).

Der Einzelrichter zieht in Erwägung:

1.

3.
Dieses Urteil wird den Parteien und dem Obergericht des Kantons Zürich, II. Zivilkammer, schriftlich mitgeteilt.

Questione giuridica chiave

Whether the appeal could be heard despite non-payment of the advance on costs under Art. 62 BGG

Decisione estratta

No. The advance on costs was duly requested, no special grounds for waiver existed, and the appellant failed to pay even within the grace period; the appeal was therefore inadmissible under Art. 108 BGG.

Motivazione estratta

Under Art. 62(1) BGG, parties must in principle pay an advance on costs in the amount of expected court costs. The appellant's refusal was incompatible with the clear statutory rule, and no exceptional circumstances justified a waiver.

Questione giuridica chiave

Allocation of court costs

Decisione estratta

Court costs were imposed on the appellant, with the amount reflecting the vexatious nature of the proceedings.

Motivazione estratta

The unsuccessful party bears the costs under Art. 66(1) BGG; the fee was adjusted in light of the dilatory manner of the litigation under Art. 65(2) BGG.
