The Federal Supreme Court did not enter into the appellant’s complaint against a cantonal order requiring the prosecutor and district office to continue criminal proceedings. It held that the challenged ruling was not a final decision under Art. 90 BGG and that no exception under Art. 93 BGG was shown. The appeal was therefore inadmissible under Art. 108 BGG. The appellant was ordered to pay court costs of CHF 800.

Massima Omnilex

Art. 90 BGG, Art. 93 BGG, Art. 108 BGG; admissibility of an appeal against a cantonal order instructing the continuation of criminal proceedings. A decision that merely orders the criminal investigation or prosecution to be continued is not a final decision if it does not terminate the cantonal proceedings. In the absence of a substantiated special ground under Art. 93 BGG, such a decision is not immediately appealable to the Federal Supreme Court. Non-admission follows by summary procedure under Art. 108 BGG. Costs are borne by the unsuccessful appellant under Art. 66 Abs. 1 BGG.

Urteil vom 28. Juni 2010
Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Einzelrichter,
Gerichtsschreiber Monn.

Verfahrensbeteiligte
X.________,
Beschwerdeführer,

gegen

Staatsanwaltschaft des Kantons Thurgau, Staubeggstrasse 8, 8510 Frauenfeld,
Beschwerdegegnerin.

Gegenstand

April 2010 (in Sachen § 008/2010).

Der Einzelrichter zieht in Erwägung:

1.

Questione giuridica chiave

Whether the federal criminal appeal was admissible against the cantonal decision ordering continuation of the investigation/prosecution.

Decisione estratta

The decision was an intermediate one and did not finally conclude the cantonal proceedings; no special case under Art. 93 BGG was invoked or shown.

Motivazione estratta

Because the challenged decision merely instructed the authorities to continue the criminal case, it was not a final decision within Art. 90 BGG. In the absence of a demonstrated exception under Art. 93 BGG, the appeal was not admissible and had to be declined under Art. 108 BGG.

Questione giuridica chiave

Who bears the federal court costs.

Decisione estratta

The appellant must bear the court costs.

Motivazione estratta

As the appeal was not entered into, the costs were imposed on the appellant pursuant to Art. 66 Abs. 1 BGG.
