The appellant challenged the Bern cantonal court's refusal to reopen his arson conviction through a third revision request. He argued that no oral hearing had been held and that his conviction depended on an earlier refusal to testify. The Federal Supreme Court held that these complaints did not satisfy the statutory reasoning requirements: the appeal did not address the cantonal court's reasons or the expert report it relied on. The Court therefore did not enter into the appeal under the simplified procedure and imposed reduced court costs of CHF 500 on the appellant.

Art. 42 Abs. 2, Art. 106 Abs. 2 und Art. 108 BGG; requirements for admissibility of a federal criminal appeal. A complaint must deal specifically with the decisive reasons of the challenged decision and, where constitutionally protected rights or the ECHR are invoked, state in a substantiated manner which legal norms were violated. Mere disagreement with the outcome or arguments that do not engage with the lower court's reasoning are insufficient. In revision matters, the absence of an oral hearing does not in itself constitute a violation where the right to be heard was preserved in writing. Costs may be reduced under Art. 65 Abs. 2 BGG if the appellant's financial situation so warrants; otherwise they are borne by the losing party under Art. 66 Abs. 1 BGG.

Urteil vom 4. Juni 2009
Strafrechtliche Abteilung

Besetzung
Bundesrichter Favre, Präsident,
Gerichtsschreiber Monn.

Parteien
X.________,
Beschwerdeführer,

gegen

Generalprokurator des Kantons Bern, Hochschulstrasse 17, 3012 Bern,
Beschwerdegegner.

Gegenstand
Revisionsverfahren (Brandstiftung),

Questione giuridica chiave

Whether the federal appeal adequately challenged the refusal of an oral hearing in the revision proceedings.

Decisione estratta

The complaint did not meet the reasoning requirements, because it did not explain how the cantonal court's approach violated federal law or the ECHR.

Motivazione estratta

The cantonal court stated that oral hearings in revision are exceptional and that the right to be heard was preserved by the appellant's written comments on the expert report and prosecutor's final submission. The appeal failed to address these reasons in a legally sufficient way.

Questione giuridica chiave

Whether the appeal adequately contested the use of the court-appointed expert report and the appellant's earlier refusal to testify.

Decisione estratta

The complaint was insufficiently reasoned, because it did not engage with the expert report on which the lower court relied.

Motivazione estratta

Neither the cantonal court nor the expert relied on the earlier refusal to testify as the basis for the decision; the appellant's submission before the Federal Supreme Court therefore missed the point.

Questione giuridica chiave

Allocation of court costs and request for free legal aid.

Decisione estratta

Court costs were imposed on the appellant, with the fee reduced in view of his difficult financial situation; no free legal aid was requested.

Motivazione estratta

As the appeal was not entered into, the appellant had to bear the costs under the Federal Supreme Court Act, while his poor finances justified a lower fee.
