The Federal Supreme Court dismissed the criminal appeal against a cantonal judgment for speeding on a motorway. The appellant had driven 8 km/h over the posted 100 km/h limit after tolerance deduction and was fined CHF 60 with 1 day substitute detention. The Court found no breach of the right to be heard in the cantonal court's treatment of a filing as a request for dispensation from the hearing, no need for a hearing in Ulm, and no federal-law error in the fine. It also refused free legal aid because the appeal was hopeless and imposed reduced court costs of CHF 800 in light of the appellant's financial situation.

Art. 95, 64, 65 and 66 BGG; right to be heard, legal aid and costs in a criminal complaint against a fine for speeding; the Federal Supreme Court reviews cantonal procedural treatment of submissions only for federal-law error, and no violation is made out where a filing is reasonably construed as a request for exemption from the main hearing. A fine set by the cantonal court is not unlawful merely because the appellant invokes illness or financial hardship, if these circumstances were expressly taken into account (consid. 1). Substitute detention need not be examined in the abstract when it is contingent on non-payment of the fine. Free legal aid is denied where the appeal lacks prospects of success; court costs may be moderated in view of the party's financial circumstances (consid. 2).

Urteil vom 27. Juni 2011

Besetzung
Bundesrichter Mathys, Präsident,
Bundesrichter Wiprächtiger, Denys,
Gerichtsschreiber C. Monn.

Verfahrensbeteiligte
X.________,
Beschwerdeführer,

gegen

Staatsanwaltschaft des Kantons Solothurn, Franziskanerhof, Barfüssergasse 28, 4502 Solothurn,
Beschwerdegegnerin.

Gegenstand

April 2011.

Das Bundesgericht zieht in Erwägung:

1.

Motivazione estratta

Under Art. 95 BGG, the Federal Supreme Court found no fault in the cantonal court's interpretation of the filing as a request for dispensation from the main hearing.

Questione giuridica chiave

Whether the fine of CHF 60 was unlawful or excessive.
