Sintesi Omnilex

The Federal Supreme Court declined to hear the criminal complaint because the appellant failed to address the cantonal court's decisive reasoning on deemed service of the first-instance decision. His assertion that he had never received the decision was therefore insufficient under the Federal Supreme Court Act. The complaint was not entered into, and the appellant was ordered to pay CHF 800 in court costs.

Art. 42 Abs. 2 BGG; Art. 108 BGG; admissibility of a federal complaint: the appellant must specifically engage with the reasoning of the challenged decision. Where the cantonal court bases inadmissibility on deemed service after uncollected postal notification, a mere assertion of non-receipt does not satisfy the duty of reasoning. If the complaint fails to address the decisive grounds, the president may decline to enter into the matter in summary proceedings under Art. 108 BGG. Court costs are borne by the unsuccessful party pursuant to Art. 66 Abs. 1 BGG.

Urteil vom 5. Mai 2014

Strafrechtliche Abteilung

Besetzung
Bundesrichter Mathys, Präsident,
Gerichtsschreiber C. Monn.

Verfahrensbeteiligte
X.________,
Beschwerdeführer,

gegen

Oberstaatsanwaltschaft des Kantons Zürich, Florhofgasse 2, 8001 Zürich,
Beschwerdegegnerin.

Gegenstand
Missachtung eines Einreiseverbots (Art. 115 Abs. 1 lit. a AuG),

Beschwerde gegen den Beschluss des Obergerichts des Kantons Zürich, III. Strafkammer, vom 17. Dezember 2013.

Das Bundesgericht zieht in Erwägung:

1.

3.

Dieses Urteil wird den Parteien und dem Obergericht des Kantons Zürich, III. Strafkammer, schriftlich mitgeteilt.

Questione giuridica chiave

Whether the federal complaint was sufficiently reasoned to be admissible

Decisione estratta

The filing did not meet the reasoning requirements, because it did not address the cantonal court's decisive finding that the decision was deemed served after uncollected postal delivery.

Motivazione estratta

Under Art. 42(2) BGG, a complaint must engage with the reasoning of the challenged decision. The appellant challenged only non-receipt, but not the decisive deemed-service reasoning. The complaint was therefore inadmissible and could not be examined under Art. 108 BGG.

Questione giuridica chiave

Allocation of federal court costs

Decisione estratta

Court costs were charged to the appellant.

Motivazione estratta

As the complaint was not entered into, the costs follow the outcome under Art. 66(1) BGG.
