The Federal Supreme Court did not enter into the criminal appeal because the appellant paid the required advance on 30 May 2014, after the fixed deadline of 26 May 2014. The appellant argued that the deadline should be recalculated from the date of receipt of the order, but the Court held that the deadline had been set as a calendar date and therefore was not to be converted. Court costs of CHF 800 were imposed on the appellant.

Massima Omnilex

Art. 108 BGG; advance payment of costs and non-entry into the appeal proceedings. Where the court fixes the deadline for the advance payment by a calendar date, the period ends on that date and is not to be recalculated according to the date of service; this is so even if the party receives the order later, provided service was timely. Failure to pay within the non-extendable grace period results in non-entry into the appeal under Art. 108 BGG (consid. 1). Court costs are charged to the appellant under Art. 66 Abs. 1 BGG (consid. 2).

Urteil vom 5. Juni 2014

Strafrechtliche Abteilung

Besetzung
Bundesrichter Mathys, Präsident,
Gerichtsschreiber C. Monn.

Verfahrensbeteiligte
X.________,
Beschwerdeführer,

gegen

Oberstaatsanwaltschaft des Kantons Zürich, Florhofgasse 2, 8090 Zürich,
Beschwerdegegnerin.

Gegenstand
Einsprache (Verleumdung usw.),

Beschwerde gegen den Beschluss des Obergerichts des Kantons Zürich, III. Strafkammer, vom 13. Februar 2014.

Der Präsident zieht in Erwägung:

1.

3.

Dieses Urteil wird den Parteien und dem Obergericht des Kantons Zürich, III. Strafkammer, schriftlich mitgeteilt.

Questione giuridica chiave

Whether the appellant’s advance payment of the court costs was timely despite payment after the stated calendar deadline.

Decisione estratta

No. The court set the deadline by calendar day, not by counting days backward from receipt of the order; the payment made on 30 May 2014 was late.

Motivazione estratta

A judge may either set a deadline by number of days or by a fixed calendar date. Here the latter was chosen. Since the order was duly served, the advance had to be paid by 26 May 2014. The appellant’s recalculation was impermissible.

Questione giuridica chiave

Whether the appeal could proceed under Art. 108 BGG after the late advance payment.

Decisione estratta

No. Because the advance payment was not made within the prescribed period, the appeal was not entered into under the summary procedure of Art. 108 BGG.

Motivazione estratta

Failure to pay the required advance within the non-extendable grace period prevents substantive consideration of the appeal.

Questione giuridica chiave

Who bears the court costs of the federal proceedings.

Decisione estratta

The appellant must bear the court costs.

Motivazione estratta

As the appeal was not entered into, costs were imposed on the appellant under the statutory costs rule.
