Sintesi Omnilex

X. appealed to the Swiss Federal Supreme Court against a decision of the president of the Neuchâtel criminal cassation court, which had refused to enter into his cantonal remedy for insufficient reasoning. The Federal Supreme Court held that the appellant's filing did not engage with the challenged non-entry reasoning and only discussed the merits of his conviction. As a result, the appeal was inadmissible under Art. 108 BGG. The court exceptionally waived the charging of court costs.

Massima Omnilex

Art. 108 BGG; inadmissibility of a federal appeal for failure to address the contested reasoning. An appeal must engage in a reasoned manner with the dispositive grounds of the challenged decision; submissions limited to the merits of the underlying conviction are insufficient. Where the appellant does not confront the lower court's non-entry reasoning and thus fails to satisfy the duty to state reasons, the court may decline to enter into the matter summarily. In exceptional circumstances, the court may waive the allocation of costs.
