Sintesi Omnilex

The Federal Supreme Court did not enter into the criminal appeal because the appellant failed to submit the challenged cantonal judgment within the deadline set under Art. 42(5) BGG. The appellant's objection against the ordering of that filing requirement was rejected. Owing to the appellant's repeated vexatious procedural conduct, the court also ordered court costs of CHF 800 against him.

Massima Omnilex

Art. 42 Abs. 5 BGG, Art. 108 BGG; failure to produce the challenged decision after an express deadline and warning leads to non-entry. An objection alleging arbitrariness or unconstitutionality does not cure the omission where the required document is not filed in time. Repeatedly vexatious procedural conduct may justify the imposition of court costs despite the non-entry outcome (cf. consid. 1-2).

Urteil vom 8. März 2011
Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Einzelrichter,
Gerichtsschreiber C. Monn.

Verfahrensbeteiligte
X.________,
Beschwerdeführer,

gegen
