The Federal Supreme Court did not enter into the appellant’s criminal complaint because he failed to challenge the cantonal court’s reasoning and instead repeated his own substantive view. The court treated his reference to unemployment and social assistance as a request for legal aid, but denied it because the appeal had no prospects of success. Court costs of CHF 500 were imposed on the appellant, reduced in light of his financial circumstances.

Art. 42 Abs. 2 and Art. 106 Abs. 2 BGG; admissibility of a complaint before the Federal Supreme Court requires reasoned engagement with the contested decision and, where fundamental rights are invoked, clear and detailed substantiation. A submission that merely repeats the party’s own view of the facts or law without addressing the decisive considerations of the lower court is insufficient and leads to non-entry under Art. 108 BGG. Legal aid under Art. 64 BGG is excluded where the appeal appears manifestly devoid of prospects of success; the party’s financial situation may be taken into account only for the amount of the court fee under Art. 65 Abs. 2 and Art. 66 Abs. 1 BGG.

Urteil vom 16. Februar 2010
Strafrechtliche Abteilung

Besetzung
Bundesrichter Favre, Präsident,
Gerichtsschreiberin Arquint Hill.

Parteien
X.________,
Beschwerdeführer,

gegen

Staatsanwaltschaft Winterthur / Unterland, 8401 Winterthur,
Beschwerdegegnerin.

Gegenstand
Einstellung des Verfahrens; Kostenauflage,

Beschwerde gegen den Beschluss des Obergerichts des Kantons Zürich, III. Strafkammer, vom 6. Januar 2010.

Der Präsident zieht in Erwägung:

1.

4.
Dieses Urteil wird den Parteien und dem Obergericht des Kantons Zürich, III. Strafkammer, schriftlich mitgeteilt.

Questione giuridica chiave

Whether the federal complaint met the reasoning requirements for admissibility.

Decisione estratta

No. The complaint did not engage with the cantonal court’s reasoning and therefore failed to satisfy the requirements of Art. 42(2) and Art. 106(2) BGG.

Motivazione estratta

The appellant merely repeated his own view of the case and did not address the specific ground for the cantonal non-entry decision, so the Federal Supreme Court could not review the matter.

Questione giuridica chiave

Whether the appellant was entitled to free legal aid.

Decisione estratta

No. The request was denied because the complaint had no prospects of success.

Motivazione estratta

Since the appeal was manifestly inadmissible, the legal aid request failed under Art. 64 BGG.

Questione giuridica chiave

Who bears the court costs.

Decisione estratta

The appellant must pay the costs, reduced in light of his financial situation.

Motivazione estratta

Costs follow the unsuccessful outcome under Art. 66(1) BGG; his unemployment and social assistance status were considered when fixing the fee under Art. 65(2) BGG.
