Sintesi Omnilex

The Federal Supreme Court considered a state constitutional complaint in a matrimonial protection case against a Zurich cassation decision. Because the cantonal decision had been received on 10 July 2006 and the complaint was only filed on 28 October 2007, the 30-day deadline under the former OG was missed by a wide margin. The complainant’s objection that the cantonal decision lacked a legal-remedy notice was rejected. The court therefore did not enter into the complaint and imposed court costs of CHF 500 on the complainant.

Massima Omnilex

Art. 89 Abs. 1 OG; state constitutional complaint and time limit; the complaint must be filed within 30 days of notification of the cantonal decision. A missing indication of the extraordinary remedy of staatsrechtliche Beschwerde does not, as a rule, excuse non-compliance with the deadline, absent applicable cantonal rules imposing such a duty (consid. 1). Where the remedy is manifestly late, the Federal Supreme Court does not enter into the matter; the unsuccessful complainant bears the costs under Art. 156 Abs. 1 OG (consid. 2).

in Erwägung,

Questione giuridica chiave

Whether the state constitutional complaint was filed within the statutory 30-day time limit.

Decisione estratta

No; the complaint was filed far outside the deadline and therefore could not be examined on the merits.

Motivazione estratta

The cantonal decision was received on 2006-07-10, while the complaint was only posted on 2007-10-28. Under Art. 89 Abs. 1 OG, the filing was obviously late.

Questione giuridica chiave

Whether the lack of a legal-remedy notice in the cantonal decision prevented the time limit from running.

Decisione estratta

No; the cassation court was not required to inform the parties about the extraordinary remedy of state constitutional complaint, subject to not-applicable cantonal rules.

Motivazione estratta

The absence of a remedy instruction was not objectionable under the applicable federal case law, so it did not excuse the late filing.

Questione giuridica chiave

Allocation of court costs after inadmissibility of the complaint.

Decisione estratta

The unsuccessful complainant had to bear the court fee.

Motivazione estratta

As the complainant was unsuccessful, costs were imposed under Art. 156 Abs. 1 OG.
