The appellant withdrew his public-law appeal against a Vaud cantonal civil judgment in an insurance annuity case. The Federal Court, by order of the president, took note of the withdrawal, struck the case from the roll, and charged the appellant with a judicial fee of CHF 500. The order also noted that the older procedural law remained applicable because the challenged decision predated 1 January 2007.

The Federal Court applies the old procedural law; upon a valid withdrawal declaration, it takes note of the withdrawal and strikes the case from the docket. Court costs are then fixed against the withdrawing appellant in accordance with Art. 40 OJ, Art. 5 al. 2 PCF and Art. 156 al. 6 OJ (consid.).

que la décision attaquée étant antérieure au 1er janvier 2007, l'ancien droit (OJ) est applicable en vertu de l'art. 132 al. 1 de la loi fédérale du 17 juin 2005 sur le Tribunal fédéral (LTF; RS 173.110);
qu'il convient de prendre acte du retrait et de rayer la cause du rôle, tout en fixant les frais dus par le recourant (art. 40 OJ et 5 al. 2 PCF, art. 156 al. 6 OJ);
Ordonne:

Il est pris acte du retrait du recours et la cause est rayée du rôle.

Un émolument judiciaire de 500 fr. est mis à la charge du recourant.

La présente ordonnance est communiquée en copie aux mandataires des parties et à la Cour civile du Tribunal cantonal du canton de Vaud.
