Upon filing of a withdrawal declaration, the Federal Court takes note thereof and removes the case from the roll without ruling on the merits. In accordance with Art. 66 al. 3 LTF, the judicial fee is as a rule borne by the withdrawing party.

les art. 32 al. 2 LTF, 71 LTF et 73 PCF;
considérant:
qu'il y a lieu de prendre acte du retrait du recours et de rayer la cause du rôle;
que, conformément à l'art. 66 al. 3 LTF, l'émolument judiciaire incombe au recourant;
ordonne:

La cause est rayée du rôle par suite de retrait du recours.

Un émolument judiciaire de 300 fr. est mis à la charge du recourant.

La présente ordonnance est communiquée en copie aux parties et à la IIe Cour d'appel civil du Tribunal cantonal de l'État de Fribourg.

Whether the subsidiary constitutional complaint should be taken off the docket after withdrawal
The Court took formal notice of the withdrawal and struck the case from the docket.
Once the withdrawal declaration was filed, there was no need to decide the merits; the case had to be removed from the roll.
Allocation of court costs after withdrawal
The judicial fee was charged to the petitioner.
Under the applicable federal cost rule, the withdrawing party bears the judicial fee.
