The husband filed a federal appeal against interim measures in a family matter, but later withdrew it. The Federal Court took note of the withdrawal and ordered the case stricken from the docket. It also set the judicial costs at CHF 300 and imposed them on the appellant pursuant to Art. 66(1) LTF. No merits review took place.
Art. 66 al. 1 LTF; withdrawal of appeal and costs: when an appeal is withdrawn, the Federal Court merely takes note of the withdrawal and strikes the case from the docket. The proceedings are terminated without a merits decision. As a rule, the withdrawing appellant bears the judicial costs, unless special circumstances justify a different allocation (consid. 1).

Les frais judiciaires, arrêtés à 300 fr., sont mis à la charge du recourant.

La présente ordonnance est communiquée aux parties, au Tribunal d'arrondissement de l'Est vaudois et à la Chambre des recours du Tribunal cantonal du canton de Vaud.

Whether the appeal should be taken off the docket after withdrawal
The Court took note of the withdrawal and ordered the case stricken from the docket.
Once the appeal had been withdrawn, there was no need to decide the merits and the proceedings had to be terminated accordingly.
Who bears the court costs after the withdrawal
The court costs were charged to the appellant.
Under Art. 66(1) LTF, the costs fall on the withdrawing appellant.
