The appellant withdrew her appeal against provisional measures in divorce proceedings. The Federal Supreme Court took note of the withdrawal, struck the case from the docket, and ordered the appellant to pay a judicial fee of CHF 300. The order was communicated to the parties and the Tribunal civil de la Glâne.
Art. 32 al. 2 LTF; art. 73 PCF in conjunction with art. 71 LTF; withdrawal of an appeal in proceedings before the Federal Supreme Court: upon valid withdrawal, the Court takes note thereof and strikes the cause from the docket. The judicial fee is normally borne by the appellant pursuant to Art. 66 al. 1 LTF, in particular where the proceedings are terminated by the appellant's withdrawal.
