The appellant filed a civil appeal against an appellate bankruptcy-opening decision of the Bern cantonal court. Before the Federal Supreme Court could decide the merits, the appeal was withdrawn by letter of 8 May 2007. The president of the II. Civil Law Division therefore struck the proceedings from the docket and, considering the withdrawal, refrained from imposing court costs. The order was also to be notified to the parties, the cantonal appellate court, and the bankruptcy office.

Es werden keine Gerichtskosten erhoben.

The proceedings are struck from the docket because the appeal was withdrawn.
Once the appeal had been withdrawn, the president of the division was required to discontinue the proceedings under the Federal Supreme Court Act and the Federal Rules of Civil Procedure by analogy.
