A constitutional complaint against a Zurich cantonal cassation ruling became moot after the appellant’s parallel appeal was allowed and the underlying Obergericht decision was annulled. The Federal Supreme Court therefore discontinued the proceedings. It allocated the court fee of CHF 5,000 to the appellant and ordered him to pay CHF 20,000 in party compensation to the respondent bank.
Mootness of a constitutional complaint after success of a parallel remedy; costs in cases of superfluous parallel proceedings. If, in the same matter, a parallel appeal is granted and the challenged cantonal decision is annulled, the constitutional complaint lacks a current object and is to be struck off as moot. Where one of two remedies pursued in the same case proves unnecessary, costs and compensation are borne by the party that initiated the superfluous procedure (consid. 1).

in Erwägung,
dass der Beschwerdeführer gegen den Beschluss des Obergerichts des Kantons Zürich, der dem mit der vorliegenden staatsrechtlichen Beschwerde angefochtenen Zirkulationsbeschluss des Kassationsgerichts des Kantons Zürich zugrunde liegt, eine Berufung einreichte, welche mit heutigem Datum gutgeheissen wurde, was zur Aufhebung des Beschlusses des Obergerichts des Kantons Zürich führt;
dass damit das vorliegende Beschwerdeverfahren gegenstandslos geworden ist, weshalb es abzuschreiben ist;
dass bei Gegenstandslosigkeit des einen von zwei in der gleichen Sache eingelegten Rechtsmitteln derjenige kosten- und entschädigungspflichtig wird, der das unnütze Rechtsmittel ergriffen hat;
dass deshalb die Kosten dem Beschwerdeführer aufzuerlegen und dieser zu verpflichten ist, die Beschwerdegegnerin für das Verfahren der staatsrechtlichen Beschwerde zu entschädigen;
beschliesst das Bundesgericht:

Das Verfahren wird infolge Gegenstandslosigkeit abgeschrieben.
2.
Die Gerichtsgebühr von Fr. 5'000.-- wird dem Beschwerdeführer auferlegt.
3.
Der Beschwerdeführer hat die Beschwerdegegnerin für das bundesgerichtliche Verfahren mit Fr. 20'000.-- zu entschädigen.
4.
Dieser Beschluss wird den Parteien und dem Kassationsgericht des Kantons Zürich schriftlich mitgeteilt.

Whether the federal constitutional complaint had become moot and should be struck from the docket.
Yes. Because the parallel appeal was allowed and the underlying cantonal decision was set aside, the present proceedings were moot and had to be discontinued.
Once the related appeal was granted, the decision challenged in the federal complaint no longer existed, leaving no live dispute for review.
How costs and compensation should be allocated after mootness in a situation where one of two parallel remedies became unnecessary.
The party that filed the unnecessary remedy had to bear the costs and compensate the opposing party.
When one of two remedies in the same matter becomes moot, the party who pursued the superfluous remedy is responsible for the procedural costs and compensation.
