Where the appellant expressly withdraws the appeal before judgment, the Federal Supreme Court merely takes note of the withdrawal and strikes the matter from the roll without examining the merits. The withdrawal entails allocation of judicial costs to the withdrawing party, absent any contrary statutory basis or special circumstance justifying a different allocation.
