The Federal Supreme Court held that the tenant’s filing could not be treated as a civil appeal because the dispute value threshold was not met and no issue of fundamental importance was shown. It therefore treated the submission as a subsidiary constitutional complaint, but found the reasoning wholly insufficient because no constitutional rights were specifically invoked and argued with reference to the cantonal judgment. The court accordingly did not enter into the matter and waived court costs.

Where the amount in dispute does not reach the statutory threshold and no legal question of fundamental importance is raised, a filing styled as a civil appeal is to be treated as a subsidiary constitutional complaint. Such a remedy allows only the allegation of violations of constitutional rights and requires specific, self-contained substantiation by reference to the reasoning of the challenged decision; mere cross-references to other submissions are inadmissible. Failure to comply results in non-entry in summary proceedings (consid. 1-3).

In Erwägung,
dass die Beschwerdeführerin auf Klage der Beschwerdegegnerin aus Mietvertrag vom Präsidenten des Bezirksgerichts Diessenhofen mit Entscheid vom 26. Mai 2009 zur Zahlung von Fr. 4'447.-- verpflichtet wurde;
dass die Beschwerdeführerin diesen Entscheid mit Berufung anfocht, auf welche das Obergericht des Kantons Thurgau mit Beschluss vom 17. November 2009 wegen Verspätung nicht eintrat;
dass die Beschwerdeführerin dem Bundesgericht eine vom 7. Januar 2010 datierte Eingabe einreichte, in der sie erklärte, den Entscheid des Obergerichts vom 17. November 2009 mit Beschwerde anzufechten;
dass eine Beschwerde in Zivilsachen im vorliegenden Fall nicht zulässig ist, weil der erforderliche Streitwert von Fr. 15'000.-- (Art. 74 Abs. 1 lit. a BGG) nicht erreicht wird und sich keine Rechtsfrage von grundsätzlicher Bedeutung im Sinne vom Art. 74 Abs. 2 lit. a BGG stellt;
dass die Eingabe der Beschwerdeführerin unter diesen Umständen als subsidiäre Verfassungsbeschwerde im Sinne von Art. 113 ff. BGG zu behandeln ist;
dass mit einer solchen Beschwerde ausschliesslich die Verletzung von verfassungsmässigen Rechten gerügt werden kann (Art. 116 BGG);
dass in der Beschwerdeschrift dargelegt werden muss, welche verfassungsmässigen Rechte durch das kantonale Gericht bzw. die kantonalen Gerichte verletzt worden sind, und solche Rügen unter Bezugnahme auf die Erwägungen des angefochtenen Entscheides zu begründen sind (Art. 42 Abs. 2 und Art. 106 Abs. 2 in Verbindung mit Art. 117 BGG);
dass die Begründung in der Beschwerdeschrift selbst enthalten sein muss, weshalb blosse Verweise auf andere Schriftstücke unbeachtlich sind (BGE 131 III 384 E. 2.3);
dass die Eingabe der Beschwerdeführerin vom 7. Januar 2010 diesen Anforderungen offensichtlich nicht genügt, weshalb auf die Beschwerde mangels hinreichender Begründung nicht einzutreten ist (Art. 108 Abs. 1 lit. b BGG);
dass unter den gegebenen Umständen auf die Erhebung von Gerichtskosten zu verzichten ist (Art. 66 Abs. 1 zweiter Satz BGG), womit das Gesuch um Befreiung von diesen Kosten gegenstandslos wird;
erkennt die Präsidentin:

Auf die Beschwerde wird nicht eingetreten.
2.
Es werden keine Gerichtskosten erhoben.
3.
Dieses Urteil wird den Parteien und dem Obergericht des Kantons Thurgau schriftlich mitgeteilt.

Whether the federal filing was admissible as a civil law appeal despite the low amount in dispute
A civil law appeal was not available because the amount in dispute was below CHF 15,000 and no legal question of fundamental importance arose.
The statutory value threshold was not met and no qualifying fundamental legal question was shown, so the filing had to be treated as a subsidiary constitutional complaint.

Whether costs should be charged
No court costs were levied in the circumstances, making the request for waiver moot.
Given the outcome, the court exercised its discretion to dispense with costs under the Federal Supreme Court Act.
