The complainant challenged an appellate judgment in a landlord-tenant dispute concerning CHF 10,880 plus interest. The Federal Court held that an ordinary civil appeal was unavailable because the value in dispute did not reach the statutory threshold and no fundamental legal question was raised. It therefore treated the submission as a subsidiary constitutional complaint, but found that the filing did not identify any constitutional rights or engage with the reasoning of the cantonal court. The court accordingly did not enter into the matter, imposed CHF 500 in court costs on the complainant, and denied the respondents party compensation.

Where the value in dispute does not reach the threshold for a civil appeal and no question of fundamental importance arises, the filing is to be treated as a subsidiary constitutional complaint. Such a remedy lies only for violations of constitutional rights and requires precise, decision-oriented pleading of the alleged infringements. A submission that merely contests the outcome without substantiating constitutional arguments is inadmissible, leading to non-entry. Costs follow the outcome; party compensation is awarded only where the successful party has incurred compensable expense.

  2. B Y.________,

Gegenstand
Mietvertrag,

Verfassungsbeschwerde gegen das Urteil des Obergerichts des Kantons Aargau, Zivilgericht, 2. Kammer, vom 14. Januar 2010.

In Erwägung,
dass die Beschwerdegegner gegen die Beschwerdeführerin im Zusammenhang mit einer Mietstreitigkeit am 9. Juni 2008 beim Bezirksgericht Klage auf Zahlung von Fr. 10'880.-- nebst Zins einreichten;
dass das Bezirksgericht die Klage mit Urteil vom 14. April 2009 teilweise guthiess;
dass das Obergericht des Kantons Aargau die von der Beschwerdeführerin dagegen erhobene Appellation mit Urteil vom 14. Januar 2010 abwies;
dass die Beschwerdeführerin dem Obergericht des Kantons Aargau eine vom 27. Februar 2010 datierte Eingabe einreichte, aus der hervorgeht, dass sie das obergerichtliche Urteil anfechten will;
dass das Obergericht des Kantons Aargau dem Bundesgericht die Eingabe in Anwendung von Art. 48 Abs. 3 BGG unverzüglich übermittelte;
dass eine Beschwerde in Zivilsachen im vorliegenden Fall nicht zulässig ist, weil der erforderliche Streitwert von Fr. 15'000.-- (Art. 74 Abs. 1 lit. a BGG) nicht erreicht wird und sich keine Rechtsfrage von grundsätzlicher Bedeutung im Sinne vom Art. 74 Abs. 2 lit. a BGG stellt;
dass die Eingabe der Beschwerdeführerin unter diesen Umständen als subsidiäre Verfassungsbeschwerde im Sinne von Art. 113 ff. BGG zu behandeln ist;
dass mit einer solchen Beschwerde ausschliesslich die Verletzung von verfassungsmässigen Rechten gerügt werden kann (Art. 116 BGG);
dass in der Beschwerdeschrift dargelegt werden muss, welche verfassungsmässigen Rechte durch das kantonale Gericht verletzt worden sind, und solche Rügen unter Bezugnahme auf die Erwägungen des angefochtenen Entscheides zu begründen sind (Art. 42 Abs. 2 und Art. 106 Abs. 2 in Verbindung mit Art. 117 BGG);
dass die Eingabe der Beschwerdeführerin vom 27. Februar 2010 diesen Anforderungen offensichtlich nicht genügt, weshalb auf die Beschwerde mangels hinreichender Begründung nicht einzutreten ist (Art. 108 Abs. 1 lit. b BGG);
dass die Kosten des bundesgerichtlichen Verfahrens dem Verfahrensausgang entsprechend der Beschwerdeführerin aufzuerlegen sind (Art. 66 Abs. 1 BGG);
dass die Beschwerdegegner keinen Anspruch auf eine Parteientschädigung haben, da ihnen aus dem bundesgerichtlichen Verfahren kein Aufwand entstanden ist (Art. 68 Abs. 1 BGG);

erkennt die Präsidentin:

1.
Auf die Beschwerde wird nicht eingetreten.

2.
Die Gerichtskosten von Fr. 500.-- werden der Beschwerdeführerin auferlegt.

3.
Dieses Urteil wird den Parteien und dem Obergericht des Kantons Aargau, Zivilgericht, 2. Kammer, schriftlich mitgeteilt.

Questione giuridica chiave

Whether the filing could be treated as a civil appeal or only as a subsidiary constitutional complaint.

Decisione estratta

A civil appeal was unavailable because the value in dispute did not reach CHF 15,000 and no legal question of fundamental importance arose; the filing had to be treated as a subsidiary constitutional complaint.

Motivazione estratta

The statutory value threshold was not met and the case did not raise a fundamental legal question.

Questione giuridica chiave

Whether the subsidiary constitutional complaint was sufficiently reasoned.

Decisione estratta

No; the submission failed to identify any constitutional rights allegedly violated and did not engage with the reasoning of the cantonal judgment.

Motivazione estratta

Under the applicable pleading requirements, constitutional grievances must be specifically pleaded with reference to the challenged decision; the filing plainly did not meet that standard.

Questione giuridica chiave

Court costs and party compensation.

Decisione estratta

Costs were imposed on the complainant; no party compensation was awarded to the respondents because they incurred no expense in the federal proceedings.

Motivazione estratta

Costs follow the outcome, and compensation requires compensable procedural expense.
