Sintesi Omnilex

A constitutional complaint against an eviction judgment was filed with the Swiss Federal Supreme Court. The appellant failed to pay the court-ordered advance on costs even within the extended deadline. The court therefore held that the complaint could not be entertained and issued a non-entry decision. It exceptionally waived court costs and did not award party compensation to the respondent, as no compensable effort had been incurred in the federal proceedings.

Art. 62 Abs. 3 BGG; non-payment of the advance on costs within the additional time limit leads to non-entry on the appeal. In the summary procedure under Art. 108 Abs. 1 lit. a BGG, the court may decide without a full panel where the requirements for entering into the matter are plainly absent. Court costs may exceptionally be waived under Art. 66 Abs. 1 second sentence BGG; party compensation is not owed where the respondent incurred no reimbursable expense.
