The appellant withdrew its civil appeal against an international arbitration award rendered by the CAS. The Federal Supreme Court took note of the withdrawal and struck the case from the docket. It also annulled its earlier order extending the CAS time limit to file a response. The appellant was ordered to pay reduced court costs of CHF 500 and reduced party compensation of CHF 8,000 to the respondent.
Art. 32 al. 2 LTF; withdrawal of the appeal: upon valid withdrawal, the Federal Supreme Court takes note thereof and strikes the cause from the roll. Any procedural order rendered only for the conduct of the appeal, such as a deadline extension for the opposing party or the arbitral tribunal, loses its object and is annulled. Costs follow the withdrawal: the withdrawing appellant bears the reduced judicial costs and owes reduced party compensation pursuant to Art. 66 al. 2 and 3 and Art. 68 al. 4 LTF, as well as the applicable costs regulation (consid. 1).

la sentence arbitral rendue le 20 octobre 2008 par le Tribunal Arbitral du Sport (TAS) dans la cause précitée;
le recours en matière civile interjeté par X.________ contre cette sentence;
les ordonnances présidentielles du 29 décembre 2008 invitant l'intimée et le TAS à déposer une éventuelle réponse au recours jusqu'au 2 février 2009;
l'ordonnance présidentielle du 28 janvier 2009 accordant sur requête une prolongation du délai au TAS jusqu'au 25 février 2009;
la réponse au recours de l'intimée du 30 janvier 2009;
la lettre datée du 30 janvier 2009, parvenue au Tribunal fédéral le 2 février 2009, par laquelle le mandataire de la recourante déclare retirer le recours;
considérant:
qu'il y a lieu de prendre acte du retrait du recours et de rayer la cause du rôle (art. 32 al. 2 LTF);
que la recourante supporte les frais judiciaires réduits et verse à l'intimée une indemnité de dépens réduits (art. 66 al. 2 et 3, art. 68 al. 4 LTF; art. 8 al. 3 du Règlement sur les dépens alloués à la partie adverse [SR 173.110.210.3]);
par ces motifs, la Présidente ordonne:

Il est pris acte du retrait du recours en matière civile.
2.
La cause 4A_540/2008 est rayée du rôle.
3.
L'ordonnance présidentielle du 28 janvier 2009 accordant au TAS une prolongation du délai pour déposer une éventuelle réponse au recours jusqu'au 25 février 2009 est annulée.

Les frais judiciaires, arrêtés à 500 fr., sont mis à la charge de la recourante.
5.
La recourante versera à l'intimée une indemnité de 8'000 fr. à titre de dépens.
6.
La présente ordonnance est communiquée aux parties et au Tribunal Arbitral du Sport (TAS).

Whether to take note of the withdrawal of the civil appeal and remove the case from the docket
The court took note of the withdrawal and struck the case from the docket.
Once the appeal had been withdrawn, there was no longer any basis to continue the proceedings; the case had to be removed from the docket under Art. 32 para. 2 LTF.
Whether the prior presidential order extending the CAS response deadline should be annulled
The extension order of 28 January 2009 was annulled.
Because the appeal proceedings were terminated by withdrawal, the deadline extension for a possible response no longer had purpose.
Allocation of court costs and party compensation after the withdrawal
Reduced judicial costs were imposed on the appellant, and the respondent was awarded reduced party compensation of CHF 8,000.
Under the Federal Supreme Court Act, the withdrawing appellant bears the reduced costs and must pay reduced compensation to the respondent.
