The appellant filed a civil appeal against a Zurich Commercial Court decision and requested legal aid. The Federal Supreme Court rejected the legal aid request, ordered a CHF 12,000 cost advance, and granted an extension. Because the advance was still not paid within the extended deadline, the Court held that it could not enter into the appeal. It therefore issued a non-entry decision, imposed CHF 1,000 in court costs on the appellant, and denied party compensation to the respondent because no expense had been incurred.
Art. 62 Abs. 3 BGG; non-payment of the requested cost advance after expiry of the extended period results in non-entry on the appeal. In such a case, the appeal is inadmissible under Art. 108 Abs. 1 lit. a BGG. Court costs are borne by the unsuccessful party under Art. 66 Abs. 1 BGG; a party compensation is not awarded where the respondent incurred no compensable expenditure.

Die Einzelrichterin hat in Erwägung,
dass der Beschwerdeführer am 9. Mai 2011 Beschwerde in Zivilsachen gegen das Urteil und den Beschluss des Handelsgerichts des Kantons Zürich vom 14. Oktober 2009 erhob und gleichzeitig das Gesuch stellte, es sei ihm für das bundesgerichtliche Verfahren die unentgeltliche Rechtspflege zu gewähren;
dass das Bundesgericht dieses Gesuch mit Verfügung vom 12. Juli 2011 abwies und dem Beschwerdeführer am 19. Juli 2011 Frist zur Bezahlung eines Kostenvorschusses von Fr. 12'000.-- ansetzte;
dass der Beschwerdeführer den ihm auferlegten Kostenvorschuss auch innerhalb der mit Verfügung vom 7. September 2011 angesetzten Nachfrist nicht geleistet hat, weshalb gestützt auf Art. 62 Abs. 3 BGG auf die Beschwerde nicht einzutreten ist;
dass die Kosten des bundesgerichtlichen Verfahrens dem Beschwerdeführer aufzuerlegen sind (Art. 66 Abs. 1 BGG);
dass der Beschwerdegegnerin keine Parteientschädigung zuzusprechen ist, da ihr durch das bundesgerichtliche Verfahren kein Aufwand erwachsen ist;
im Verfahren nach Art. 108 Abs. 1 lit. a BGG erkannt:

Auf die Beschwerde wird nicht eingetreten.
2.
Die Gerichtskosten von Fr. 1'000.-- werden dem Beschwerdeführer auferlegt.
3.
Dieses Urteil wird den Parteien und dem Handelsgericht des Kantons Zürich schriftlich mitgeteilt.
