Sintesi Omnilex

The appellant challenged a cantonal expulsion decision before the Federal Supreme Court. After the court ordered him to pay a CHF 500 advance on costs and granted an extension of the deadline, he still failed to pay. The First Civil Law Court therefore held the appeal inadmissible for non-payment of the advance and ordered the appellant to bear the judicial costs fixed at CHF 500.

Art. 62 al. 3 LTF; inadmissibility of an appeal for failure to pay the advance on costs within the prescribed or extended time limit. Where the appellant does not comply with the order to furnish the advance, the court may not enter into the merits and must declare the appeal inadmissible under Art. 108 al. 1 let. a LTF. The judicial costs are then imposed on the appellant in accordance with Art. 66 al. 1 and 3 LTF.
