The appellant informed the Federal Supreme Court that the parties had reached an out-of-court settlement and withdrew its appeal against the Commercial Court of Zurich judgment. The Court struck the case from the docket as withdrawn. It ordered the appellant to pay CHF 50,000 in court costs, taking into account the high dispute value and the procedural progress already made. No party compensation was awarded, as both sides had waived such compensation for the federal proceedings.
Art. 66 Abs. 1 BGG; withdrawal of the appeal and allocation of costs: where the appellant withdraws the appeal after an out-of-court settlement, the proceedings are struck from the docket. In Erwägung,
dass die Beschwerdeführerin dem Bundesgericht mit Schreiben vom 22. Juni 2011 mitteilte, die Parteien hätten einen aussergerichtlichen Vergleich geschlossen, und ihre Beschwerde vom 21. Februar 2011 gegen das Urteil des Handelsgerichts vom 14. Januar 2011 zurückzog;
dass das Verfahren als durch Rückzug erledigt abzuschreiben ist;
dass die Beschwerdeführerin kostenpflichtig ist (Art. 66 Abs. 1 BGG);
dass bei der Bemessung der Gerichtskosten neben dem hohen Streitwert von rund Fr. 37 Mio. zu berücksichtigen ist, dass die Beschwerdeantwort bereits am 8. April 2011 der Beschwerdeführerin zur Kenntnisnahme zugestellt wurde, dass die Beschwerdeführerin in der Folge das Bundesgericht nicht über die Führung von Vergleichsgesprächen orientierte und keine Sistierung des Verfahrens aus diesem Grund verlangte und dass der Beschwerderückzug erst erfolgte, nachdem die bundesgerichtliche Instruktionsrichterin ein umfangreiches Urteilsreferat ausgearbeitet und im Sinne von Art. 58 Abs. 2 BGG in Zirkulation gesetzt hatte;
dass der Beschwerdegegnerin keine Parteientschädigung zuzusprechen ist, nachdem die Parteien gegenseitig auf Prozessentschädigungen für das bundesgerichtliche Verfahren verzichtet haben;
verfügt die Instruktionsrichterin:

Das Verfahren wird infolge Rückzugs der Beschwerde abgeschrieben.
2.
Die Gerichtskosten von Fr. 50'000.-- werden der Beschwerdeführerin auferlegt.
3.
Diese Verfügung wird den Parteien und dem Handelsgericht des Kantons Zürich schriftlich mitgeteilt.
