H.X. and F.X. filed a civil appeal to the Federal Supreme Court against a judgment of the Vaud cantonal appeal chamber. Before the Court ruled on the merits, they withdrew the appeal by letter of 4 April 2011. The President of the First Civil Law Court therefore ordered the case struck from the docket pursuant to Art. 32 para. 2 LTF and charged the appellants with judicial costs of CHF 300.
Art. 32 al. 2 LTF; withdrawal of an appeal before judgment; the proceedings are terminated by striking the case from the docket. Upon withdrawal, the court does not decide the merits; it merely notes the procedural termination and, absent contrary circumstances, allocates judicial costs to the withdrawing appellants (consid. 1).
