Sintesi Omnilex

The Federal Supreme Court dealt with a detainee's letter challenging the cantonal decision confirming his detention pending removal. It held that the filing did not satisfy the mandatory reasoning requirements of Art. 42 LTF because it did not explain how the cantonal judgment violated the law. The appeal was therefore manifestly inadmissible and decided under the simplified procedure of Art. 108 LTF without exchanging written submissions. Given the circumstances, no court fee was imposed.

Massima Omnilex

Art. 42 LTF; admissibility of a federal appeal requires a reasoned submission showing, in a concise manner, how the contested decision violates law; a mere declaration of intent to appeal or unsubstantiated criticism does not suffice. Where the filing manifestly fails to meet these requirements, the Federal Supreme Court may dispose of the matter in simplified procedure under Art. 108 al. 1 lit. b LTF without ordering an exchange of observations. In such circumstances, and depending on the case, costs may be waived under Art. 66 al. 1 LTF (consid. 4-5).

Arrêt du 30 novembre 2011
IIe Cour de droit public

Composition
M. le Juge Zünd, Président.
Greffier: M. Dubey.

Participants à la procédure
X.________, recourant,

contre
