X.________ appealed against the cantonal decision confirming his detention pending removal. Before the Federal Supreme Court could decide, he was deported to Austria on 20 December 2010. The Court held that the case had become moot, struck it from the docket, and ordered that no judicial costs be levied. The order was issued by the President of the II Civil/Public Law Division without party compensation.
Art. 32 al. 2 LTF; mootness of the appeal after removal of the detained foreign national; when the challenged detention pending removal has lost its object through deportation, the Federal Supreme Court strikes the matter from the docket. In such a situation, the proceedings are terminated without adjudicating the merits. Costs may be waived, in particular where the case is removed from the docket as moot and the circumstances justify no judicial fees (consid. 1).

que l'intéressé a été renvoyé en Autriche le 20 décembre 2010,
que la cause est devenue sans objet (cf. art. 32 al. 2 LTF), qu'il convient de la rayer du rôle et de statuer sans frais ni dépens (cf. art. 5 al. 2 et art. 73 PCF par renvoi de l'art. 71 LTF; art. 66 al. 2 LTF),
par ces motifs, le Président ordonne:

La cause 2C_938/2010, devenue sans objet, est rayée du rôle.
2.
Il n'est pas perçu de frais judiciaires.
3.
La présente ordonnance est communiquée aux parties, au Service de la population et des migrations du canton du Valais, au Juge unique de la Cour de droit public du Tribunal cantonal du canton du Valais et à l'Office fédéral des migrations.
