The Federal Supreme Court held that the challenge to a three-year entry ban was not admissible by way of public law appeal under Art. 83 lit. c ch. 1 BGG. A subsidiary constitutional complaint was likewise unavailable because the contested judgment came from the Federal Administrative Court, not a last cantonal instance. The court therefore did not enter into the case in simplified proceedings. It also refused legal aid due to the manifest lack of prospects and ordered the appellant to pay CHF 500 in court costs.

Art. 83 lit. c ch. 1 BGG; Art. 108 Abs. 1 lit. a BGG; Art. 113 BGG; Art. 64 BGG; Art. 66 Abs. 1 BGG; admissibility of federal remedies against an entry ban. Decisions in the field of immigration law concerning entry are excluded from the public law appeal. A subsidiary constitutional complaint is available only against decisions of last cantonal instances and is therefore inadmissible against judgments of the Federal Administrative Court. Where the chosen remedy is manifestly barred and the appeal is hopeless from the outset, legal aid must be refused. In such a case, the court may issue a non-entry decision in the simplified procedure and allocate costs to the unsuccessful party (consid. 1-4).

Urteil vom 10. März 2010
II. öffentlich-rechtliche Abteilung

Besetzung
Bundesrichter Müller, Präsident,
Gerichtsschreiber Feller.

Verfahrensbeteiligte
X.________,
vertreten durch Y.________,
Beschwerdeführerin,

gegen

Bundesamt für Migration.

Gegenstand
Einreisesperre,

Beschwerde gegen das Urteil des Bundesverwaltungsgerichts, Abteilung III, vom 2. Februar 2010.

Februar 2010,

in Erwägung,

Questione giuridica chiave

Whether the public law appeal was admissible against an entry ban in immigration law.

Decisione estratta

The public law appeal was inadmissible because the challenged judgment concerned an entry ban, and such decisions are excluded under Art. 83 lit. c ch. 1 BGG.

Motivazione estratta

The subject matter was an entry ban in immigration law, which falls within the statutory exclusion from public law appeal; therefore the court had to refuse entry under the simplified procedure.

Questione giuridica chiave

Whether a subsidiary constitutional complaint was available against the Federal Administrative Court judgment.

Decisione estratta

The subsidiary constitutional complaint was also inadmissible because it lies only against final cantonal decisions, not against judgments of the Federal Administrative Court.

Motivazione estratta

The challenged decision was issued by a federal court, not a last cantonal instance, so the statutory precondition of Art. 113 BGG was missing.

Questione giuridica chiave

Whether legal aid should be granted.

Decisione estratta

Legal aid was denied because the appeal was manifestly hopeless.

Motivazione estratta

Since both attempted remedies were clearly inadmissible, the application had no prospects of success within the meaning of Art. 64 BGG.

Questione giuridica chiave

Who bears the court costs.

Decisione estratta

Court costs of CHF 500 were imposed on the appellant.

Motivazione estratta

Costs follow the outcome under Art. 66 Abs. 1 Satz 1 BGG.
