A Turkish national challenged the Aargau authorities' refusal to grant him a humanitarian residence permit. The Federal Supreme Court held that the administrative law appeal was inadmissible because he had no statutory entitlement to the permit. It further found that he could not derive a right from Article 8 ECHR or Article 13 BV, nor from the cited ordinance provisions, and that any abuse-of-discretion argument under the ANAG was irrelevant absent a right. The Court therefore refused to enter into the appeal, denied legal aid, and charged the court fee to the appellant.
Art. 100 Abs. 1 lit. b OG; admissibility of administrative law appeal against refusal of a residence permit. The remedy is available only where federal law confers an enforceable entitlement to the requested foreign-police permit. No such entitlement can be derived from Art. 8 ECHR or Art. 13 BV unless the applicant or family members hold a sufficiently secure residence position and the circumstances of stay justify protection of family or private life as a residence right (consid. 2). Provisions of the Ordinance on the Admission, Residence and Employment do not themselves create a federal right to issuance of the permit. In the absence of standing on the merits, allegations of abuse of discretion under Art. 4 ANAG are not cognizable; legal aid is denied where the appeal is manifestly devoid of prospects (Art. 152 OG).
