Sintesi Omnilex

C. filed a constitutional complaint against a parliamentary initiative concerning amendments to the Criminal Code on abortion. The Federal Supreme Court held that such a challenge was not admissible: a state-law complaint lies only against cantonal acts, the limited federal remedy under political-rights law did not apply, and the Court may not review the constitutionality of federal statutes. The Court therefore declined to enter into the complaint and waived court costs.

Art. 84 Abs. 1 OG, Art. 85 lit. a OG, Art. 100 lit. p OG, Art. 80 BPR, Art. 191 BV; admissibility of a challenge against a federal legislative act. A staatsrechtliche Beschwerde is confined to cantonal enactments, decisions and elections/votations, while the Verwaltungsgerichtsbeschwerde in matters of political rights is available only within the narrow scope provided by the Federal Act on Political Rights. Federal statutes are not subject to constitutional review by the Federal Supreme Court pursuant to Art. 191 BV; a complaint directed against a federal law or legislative initiative is therefore manifestly inadmissible and results in non-entry.

Bundesversammlung, 3003 Bern.

parlamentarische Fristenlösungs-Initiative

Questione giuridica chiave

Whether the complaint against the federal statute/amendment concerning abortion was admissible before the Federal Supreme Court.

Decisione estratta

The complaint was inadmissible; a constitutional complaint cannot be directed against federal enactments, and the limited remedy under political-rights law also did not apply. The Court could not review the constitutionality of federal statutes.

Motivazione estratta

Direct constitutional review is excluded for federal laws; the available remedies under the Federal Judicature Act and the Federal Act on Political Rights did not cover the challenge raised, and Art. 191 BV prevents the Court from examining the constitutionality of federal statutes.
